Welcome to tealkitchenandcafe.com. By accessing or using this website, placing an order, or engaging any of our services, you agree to be bound by the following Terms of Use. Please read them carefully.
1. General Use
This website is operated by enRoot Hospitality Group, Inc. ("we," "us," or "our"). You agree to use this site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of this website. We reserve the right to modify or discontinue any part of the site at any time without notice.
2. Online Ordering – Refunds & Cancellations
Order Cancellations: Orders may be cancelled within 10 minutes of placement by contacting us directly. Once an order has been prepared or dispatched, it cannot be cancelled.
Refunds: If your order is incorrect or does not meet our quality standards, please contact us within 24 hours of receipt at info@tealkitchenandcafe.com or by calling us directly. We will make it right by offering a replacement, store credit, or refund at our discretion.
Delivery: We are not responsible for delays caused by third-party delivery services. If a delivery is significantly delayed or lost, please contact us and we will work to resolve the issue.
3. Off-Premise Events & Full Service Catering
Booking & Deposit: Catering events require a signed agreement and a deposit of 50% of the estimated total at the time of booking. This deposit confirms your date and allows us to begin sourcing and preparing for your event.
Cancellation by Client: Cancellations made 14 or more days before the event date will receive a full refund of the deposit. Cancellations made 7 to 13 days before the event date will receive a 50% refund of the deposit. Cancellations made fewer than 7 days before the event date are non-refundable.
Cancellation by Teal Kitchen & Cafe: In the unlikely event that we must cancel due to circumstances beyond our control, we will provide a full refund of any deposits paid.
Final Payment: The remaining balance is due no later than 48 hours before the event date.
Guest Count Changes: Final guest counts must be confirmed no later than 72 hours before the event. We cannot guarantee accommodation for increases beyond the confirmed count within this window.
4. Online Catering Orders
Order Minimums: Online catering orders require a minimum order of $100 for pickup and $150 for delivery.
Advance Notice: All online catering orders require a minimum of 48 hours advance notice. Orders placed with less than 48 hours notice are subject to availability and may incur a rush fee of 20% of the total order. Rush orders are not guaranteed and are confirmed only upon receipt of payment.
Delivery: Delivery for online catering orders is fulfilled through a third party delivery service. Teal Kitchen & Cafe is not responsible for delays or issues caused by the delivery provider. If a delivery issue arises, please contact us and we will do our best to make it right.
Cancellations & Refunds: Online catering orders may be cancelled up to 48 hours before the scheduled pickup or delivery time for a full refund. Cancellations made within 48 hours are non-refundable as ingredients will have already been sourced and prepared.
4. Gift Card Terms
– Teal Kitchen & Cafe gift cards are redeemable for food, beverages, and catering services at participating locations.
– Gift cards have no expiration date and are not redeemable for cash, except where required by law.
– Lost or stolen gift cards cannot be replaced unless the original purchase receipt is provided.
– Gift cards cannot be used to purchase other gift cards.
– Teal Kitchen & Cafe is not responsible for unauthorized use of gift cards.
5. Wholesale Account Terms
Eligibility: Wholesale accounts are available to qualified businesses. Approval is at our discretion and may require proof of business registration.
Ordering: Wholesale orders must meet a minimum order quantity as specified in your wholesale agreement. Orders must be placed with a minimum of [48–72 hours] advance notice.
Payment: Wholesale accounts are payable upon delivery unless a net payment term has been established in writing. Late payments may result in suspension of the account.
Returns: Perishable wholesale items are non-returnable. Quality issues must be reported at the time of delivery or within 24 hours.
6. Intellectual Property
All content on this website, including text, images, logos, and graphics, is the property of enRoot Hospitality Group, Inc. and may not be reproduced, distributed, or used without our express written permission.
7. Limitation of Liability
To the fullest extent permitted by New York law, Teal Kitchen & Cafe and enRoot Hospitality Group, Inc. shall not be liable for any indirect, incidental, or consequential damages arising out of your use of this website or our services. Our total liability for any claim related to our services shall not exceed the amount paid by you for the specific order or service in question.
8. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the State of New York. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Suffolk County, New York.
9. Changes to These Terms
We reserve the right to update these Terms of Use at any time. Changes will be effective upon posting to this page with an updated date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
